WESTBURY BUSINESS MAN CHARGES NASSAU COUNTY POLICE AND DISTRICT ATTORNEY WITH SUPPORTING CORRUPTION AND ABUSE OF OFFICIAL AUTHORITY THAT LED TO HIS FALSE ARREST AND MALICIOUS PROSECUTION

Mr. Roy S. Tuccillo, is filing a Federal Civil Rights Complaint against the County of Nassau, the Nassau County Police Department, the Nassau County District Attorney, Detectives John R. Capece and others for their abuse of power, abuse of process and corruption all of which led to him being falsely arrested, falsely charged, falsely jailed, maliciously prosecuted and otherwise violated. A Press Conference will be held on August 12, 2013 at 10:00 a.m. at the Law Offices of Frederick K. Brewington, located at 556 Peninsula Blvd., Hempstead, New York, 11550 announcing the filing of this lawsuit and charging the Nassau County Police Department and others with intentionally using their official authority to manufacture false testimony and evidence against him in order to foster corrupt activity. It is his intent to file a Complaint suing these parties for their intentional and violative acts taken against him.

This matter arises out of an incident which occurred on June 1, 2011 and thereafter, during which COUNTY OF NASSAU, NASSAU COUNTY POLICE DEPARTMENT, DETECTIVE JOHN R. CAPECE , in his individual and official capacity, DETECTIVE DONALD BITTNER, in his individual and official capacity, RICHARD TOBIN, POLICE OFFICER WILLARD S. GOMES, in his individual and official capacity, POLICE OFFICERS JOHN DOE 1-10, in their official and individual capacities, (those being the names of officers who were present and committed wrongful acts and whose names are known by the other Defendants), NASSAU COUNTY OFFICE OF THE DISTRICT ATTORNEY, conspired to and did file false reports which alleged that ROY S. TUCCILLO engaged in Criminal Mischief in the Second Degree, a Class D Felony and thereafter filed further false charges of Menacing and Harassment all of which caused Mr. Tuccillo to be falsely arrested, wrongfully detained, subjected to abuse, maliciously prosecuted and otherwise violated.

At the press conference Mr. Tuccillo will relate how he was the victim of an attack and road rage by RICHARD TOBIN. After attacking Mr. Tuccillo, RICHARD TOBIN relying on his personal relationship with the Chief of Detectives JOHN R. CAPECE, called Detective Capece on the telephone and had Detective Capece use his authority, power, position and status to have Police Officer Willard S. Gomes arrest Mr. Tuccillo and taken into custody. Further, through this corrupt use of power and authority, Detective Donald Bittner, along with Police Officer Gomes, and others assisted in the wrongful arrest and prosecution of Mr. Tucillo by drafting and lodging false felony charges against claimant.

Mr. Tuccillo will appear at the Press Conference with his Attorney, Frederick K. Brewington to relate how this was the ultimate abuse of power and corruption, making him the victim with one phone call to a ranking member of the Nassau County Police Department. [Mr. Tuccillo was arrested by the Nassau County Police Department charging him with a crime he did not commit.] Rather than investigating this as they should, they dragged Mr. Tuccillo through the Court system to punish him, subjecting him to cruel and demeaning treatment and then tried to cover-up their wrongful acts.
