New York Law Journal: DWI Case Turns on Access to Counsel Before Breath Tests

On March 26, Frederick K. Brewington came to the Court of Appeals to argue on behalf of his client, Jonai Washington. Mr. Brewington told the court that police officers do not have the right to interfere in attorney-client relationships. He claimed that Nassau County police denied Ms. Washington her right to speak to an attorney and forced her to submit to a breath test after her involvement in a car crash.

On August 30, 2010, Ms. Washington was involved in a crash on Uniondale Avenue in Hempstead. Police indicated she showed signs of drunkenness and had her submit to a breath test. At the same time Ms. Washington signed a form consenting to a breath test, her attorney called police headquarters and told the officers to stop all questioning and that she does not have to subject herself to any breath tests. Nearly 10 minutes later, the breath test was administered without her being notified by police that her attorney had called.
