Court Allows Excessive Force and False Imprisonment Case to Proceed Against Village of Hempstead Police

The United States District Court, Eastern District of New York, recently denied a motion for summary judgment in favor of the Plaintiff, Shuay'b Greenaway, an African-American male diagnosed with a mental illness, who is alleging false imprisonment and excessive force after being shocked with a stun gun multiple times by Nassau County police officers.

April 25, 2010, both Nassau County and Village of Hempstead police responded to a 911 call by Mr. Greenaway's mother, Sharon Knight, citing that her son, who is diagnosed with bipolar disorder, was at their home but had not taken his medication for one day. Although Ms. Knight explained to the officers that he was not dangerous, the officers decided that Mr. Greenaway needed to be hospitalized and physically removed him from their home.

As officers proceeded to physically remove him, Mr. Greenaway sustained puncture wounds and was stun-gunned multiple times. Greenaway had to be treated for anxiety as a result of the incident.

According to court testimony, the Hempstead police kept Mr. Greenaway locked in the bathroom against his will while they pushed Ms. Knight and her husband, Avery Knight, aside. It was also reported that, although the officers did not tase Mr. Greenaway, they did nothing to stop the Nassau police officers from tasing him.

The defendant's motion for summary judgment was filed on September 20, 2013. On April 29th, 2015, the United States District Judge William F. Kuntz II ruled to deny the Hempstead police summary judgment motion to dismiss the false imprisonment and excessive force claims because multiple material facts are being disputed by the parties involved in the case. The officers' claim that they were entitled to qualified immunity was also denied. Mr. Brewington and Senior Associate, Gregory Calliste, Jr. are working on this case.
