U.S. District Court Allows Nassau Correction Officer’s Racial Discrimination Lawsuit to Go Forward

A U.S. District Court Judge recently ruled that a $45 million wrongful discrimination lawsuit filed by Rodney Johnson, a client of the Law Offices of Frederick K. Brewington, against the Nassau County Sheriff’s Department may proceed. The lawsuit alleges that Mr. Johnson was subjected to racial discrimination, harassment and humiliation at the hands of his fellow correction officers.

Mr. Johnson, who has been a correction officer since August of 1993, says the harassment began a short while after he was elected to be a drill instructor as part of the Correction Department’s High Impact Incarceration Program. The suit claims that Mr. Johnson reported the unjust treatment by a fellow correction officer Manny DaSilva, citing “assault, ridicule and harassment.” Mr. Johnson also claims that Mr. DaSilva physically threatened him after hearing of the complaints. Shortly afterward, Mr. Johnson was transferred to the Law Library as punishment for filing the complaints.

On December 30, 2010, Mr. Johnson filed suit, claiming that the Sheriff’s Department and eight county employees were responsible for acts of discrimination, harassment and subsequent failure to act. Despite the county’s attempts to have the case dismissed, a U.S District Judge ruled on September 2, 2014 that Mr. Johnson has a right to pursue claims regarding retaliation, a hostile work environment and human rights violations.

A trial date has not been scheduled at this time.
