Retrial in Civil Rights Case: Second Chance to Prove Suffolk County Injustices

U.S. District Judge Joanna Seybert declared a mistrial in the civil case of Perrim Anderson, in which he was to be awarded $65,000 after being brutally beaten by Suffolk County correction officers for requesting to wear socks. Judge Seybert stated that there were inconsistencies and confusion among jurors that would require a new trial. The jury was asked to issue a verdict twice, as to whether Deputy Sheriff Vincent Aparicio used excessive force against Mr. Anderson (a violation of federal law) and beat him (a violation of state law), but on both occasions their reasoning was unclear and did not follow the Court’s instructions. In the first verdict, jurors were unsure if the $65,000 award was for violation of state or federal law. The jurors’ second verdict stated that the federal law had been violated, but not the state law. The ruling did not follow the judge’s instructions because she had informed the jurors that if they found that excessive force had been used, a violation of the federal law, their decision would automatically mean that state law against battery had also been violated. With the verdict thrown out, the Law Offices of Frederick K. Brewington now have the chance to argue that the injuries and injustices that Perrim Anderson suffered are worth more than $65,000. A date for the retrial has not yet been set.
