$7.75 million- Civil Rights and wrongful death action brought by the family of deceased

$4.7 million- Repeated verbal and physical assaults on Yemeni-American employee, while supervisor failed to protect employee and discipline the assailant

Court Decides to Allow the Million-dollar Status of the Case to Remain
Shuay’b Greenaway and His Family Receive Award for Excessive Force, Failure to Intervene and Trespass


The trial in this matter, Greenaway v. Nassau County and the Village of Hempstead, took place in Federal District Court, Eastern District of New York, beginning on May 15, 2017, and ended in a jury verdict awarding the Plaintiffs $8.4 million. Following post-trial motions made by the Defendants, the largest part of the award, which was the pain and suffering and emotional damages for which he jury awarded $7.5 million against the defendants, was lowered. Judge LaShann DeArcy Hall remitted the $7.5 million down to $2.5 million and addressed some of the damages which we agreed were double recovery. This was a solid victory and a great result for Mr. Shuay’b Greenaway and his parents, Sharon and Avery Knight.

The lawsuit was filed against a group of Village of Hempstead and Nassau County police officers who Tased Mr. Greenaway and verbally and physically abused his parents as they attempted to remove Mr. Greenaway from the premises. Mr. Greenaway and his family were awarded damages for excessive force, and unlawful entry/trespass, as well for the officers who failed to intervene to stop the abuse.

In April 2010, Hempstead Village and Nassau County police officers came to the house after his parents were concerned about his whereabouts. Police found Mr. Greenaway in the house, painting the bathroom. Mrs. Knight said that her son, who is bipolar, had not taken his medication. The officers repeatedly asked Mr. Greenaway to go to the hospital, but he said he refused to do so until he was done painting the bathroom. As the officers crowded around Mr. Greenaway, Mr. Knight yelled at them to leave his house.

Soon, one of the officers pulled out what Mrs. Knight thought was a gun. He pushed her out of the bedroom, while Mr. Knight tried to get to his son, but was shoved out into the hallway. A Nassau County officer Tased Mr. Greenaway, although he did not pose to be a threat to himself or anyone else. Mr. and Mrs. Knight were traumatized by the sound of the electricity running through their son’s body and his screams of anguish. He was later taken to a local hospital. In total, Mr. Greenaway was Tased four times and each time was more painful than the first.
