The Law Offices of Frederick K. Brewington announced that the firm’s motion to dismiss criminal mischief charges against Nieshawn Bazil. In a supporting deposition given by Christopher Myers, a store manager with Best Yet Supermarket in East Rockaway, he said that he had a termination meeting with another employee, SC, Mr. Bazil’s girlfriend. When Mr. Bazil learned of his girlfriend’s termination of employment, according to Mr. Myers, he kicked in the door to Mr. Myers’ office and began to shout profanities at Mr. Myers. Mr. Bazil denied these charges and maintained his innocence throughout the case. The deposition later described that Mr. Bazil headed into the store area, knocked down a cake display, picked up a metal magazine rack and threw it at a storefront window, causing $3,500 in damage. The case started out with felony charges, which were later lowered to misdemeanor charges and transferred from the County Court to the District Court. After reviewing the matter in detail, it was discovered that, despite the claim made in his statement, it became clear that the sworn statement of Mr. Myers never confirmed that he actually witnessed Mr. Bazil destroying the cake display or the window. In a decision dated July 25, 2018, the Hon. Valerie J. Alexander of the District Court of Nassau County, First District, Criminal Term, granted a motion to dismiss the charges and stated, “[t]he People therefore have thirty days to file a sufficient information or the accusatory instrument will be dismissed.” On October 11, 2018, the Prosecutor declared that they were not going to refile the charges and the Court summarily dismissed the criminal charges against Mr. Bazil.
